NIE and registration for temporary renters in Mallorca: what you actually need

Do you need a NIE for a monthly rental in Mallorca? When the number is worth it, how to get it, and what empadronamiento means for temporary tenants.

Few topics worry temporary renters more than Spanish bureaucracy. The good news first: you do not need a NIE to rent. A valid passport or ID card is enough to sign a seasonal rental contract. Here is the honest overview of what you actually need, and when.

The NIE: what it is and when it pays off

The NIE (Número de Identidad de Extranjero) is your Spanish foreigner identification number. It is not a residence permit, just a number the administration uses to recognise you. You do not need it for the rental contract, but you will need it for almost everything beyond it:

The rule of thumb: 1 to 3 months without working is perfectly doable without a NIE. If you stay longer, work here, or want contracts in your own name, apply early, because appointments are the bottleneck.

How to get the NIE

  1. Book an appointment (cita previa) online with the Extranjería or national police in Palma. Slots often run weeks ahead.
  2. Fill in form EX-15 and state your reason (for example, economic or social interests in Spain).
  3. Pay the fee (Modelo 790-012, around 10 €) at a bank beforehand.
  4. Bring passport, copies, the form and the payment slip. The number arrives immediately or within days, depending on the office.

Alternatively, apply through a Spanish consulate in your home country before you travel, which is often calmer. If you want to skip the whole exercise, a gestoría will handle it for a small fee.

EU citizens and the 90-day question

As an EU citizen you can stay in Spain freely, no formalities. If you plan to stay longer than three months in one go, the law expects you to register in the central foreigners register (the green Certificado de Registro, which includes your NIE). For a classic five-month winter that is the formally correct route; in practice, long-stay visitors decide based on their situation. If you work or want to build residency, there is no way around it.

Empadronamiento: registering at the town hall

The empadronamiento is the registration of your address with the municipality. You need your rental contract and your ID. For short stays it is unusual; it becomes relevant when you move your life here, register a car or use public services. A MUVAWAY seasonal contract is normally accepted by town halls as proof of address.

The bottom line for your monthly rental

For 1 to 3 months: your passport is enough, just come. From around 3 months, or with work plans: apply for the NIE early, appointment first. Everything else, from contract to deposit, is handled by the seasonal rental agreement, and that only needs you and your ID.

What works without an NIE anyway

The list is longer than most people expect. Without a Spanish tax number you can conclude and sign a seasonal tenancy, pay rent and deposit by transfer from abroad, buy a Spanish SIM card on your passport and see a doctor privately.

The European Health Insurance Card also works without an NIE: it entitles EU citizens to treatment in the public system on the same terms as locals. For a stay of a few months that is generally enough.

What does not work without an NIE: opening a regular Spanish bank account, registering a car in your name, putting utility contracts for electricity and water in your name, or buying property. For a seasonal rental you need none of that — the utility contracts stay with the owner.

The difference between NIE, residencia and empadronamiento

These three are constantly confused, and they mean entirely different things.

The NIE is only an identification number for foreigners. It says nothing about where you live and confers no residence status. It does not expire.

The residencia is registration as a resident. EU citizens staying longer than 90 days are expected to enter the central register and then receive a green certificate with the NIE on it.

The empadronamiento is registration in the municipal population register. It records that you live at a particular address and is the prerequisite for nursery and school places and a family doctor in the public system.

For a seasonal rental you need none of the three. Registering does, however, signal a centre of life in Spain — and that can touch on how the tenancy is classified, as described under the temporary purpose.

Tax residence: the 183-day rule

The point most people overlook: tax residence depends neither on the NIE nor on registration, but on presence. Anyone spending more than 183 days in Spain in a calendar year is generally treated as tax resident here — meaning worldwide income has to be declared in Spain.

That is exactly why our ten-month ceiling is not accidental. Ten months in one run can span two calendar years and stay under the threshold in each — but it can also cross it if the period falls awkwardly.

If you come anywhere near that line, have a gestoría or a tax adviser run the numbers before you sign. It costs little and spares you an unpleasant surprise the following year. How the length of the let plays into this is also covered in one to ten months.

What to bring in practice

For the tenancy itself your ID card or passport is enough, front and back. Nothing else — no payslips, no guarantor, no NIE.

Still worth having: travel health insurance or the EU card, a bank account you can transfer euros from, and the document evidencing your reason for the stay. The last of these belongs to the contract, not the listing.
